Enduring Power of Attorney in Israel

This article addresses an enduring power of attorney in Israel, what it is, why it’s important, and the process involved in making one.  This falls under family law, which is under the Israeli Ministry of Justice.

What Is Enduring Power of Attorney in Israel

Enduring power of attorney, referred to as yipuy coakh mitmashekh in Hebrew, is also commonly called a lasting or continuing power of attorney in English.  It is a document granting authority to a third party to make personal, financial and legal decisions on one’s behalf in the event that one becomes mentally unfit to make their own decisions.  The person(s) appointed power of attorney is called meyupeh coakh.

Why It’s Important to Have This Power of Attorney

There are many reasons why it’s important to have an enduring (or continuing) power of attorney in Israel.  First, it gives individuals the legal power to set their personal, financial and health preferences for the future. In the event that someone does not choose to appoint a meyupeh coakh (and doesn’t have an enduring power of attorney), the Israeli court will decide on a legal guardian (apotropus) who will be in charge of the well-being of that individual. Second, it is economical in that it spares the individual and their family conflict during legal proceedings as the family may not agree about who should make the decisions regarding the individual, also saving time and money, avoiding many hours spent in court in the future.

Who Can Draft an Enduring Power of Attorney
